The agreement between you and us for using Equific. Written to be read — if a clause here is unclear, that is a fault worth telling us about.

Every item written as [[ LIKE THIS ]] is a fact only the operator can supply. This document is not in force until they are filled in and the whole thing has had legal review.
The agreement
These terms are between you and [[ LEGAL ENTITY NAME ]] ("we", "us"). Using Equific means you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
What the service is
Equific is a hosted control panel. You connect Ubuntu servers you already own or rent, and we provision, deploy to, monitor, back up and migrate them on your instruction over SSH.
We do not provide servers, hosting or bandwidth. Your relationship with your hosting provider is yours, including its bills and its terms.
Accounts
Accounts are created by invitation. You are responsible for what happens under yours, so keep your password and two-factor device to yourself and tell us promptly if you think either has been compromised.
One person per account. Sharing a login makes the activity log meaningless, which is the record you will want if something goes wrong.
Your servers, your responsibility
By connecting a server you confirm that you own it or are authorised to administer it. Equific will do what you tell it to on that machine, including things that cannot be undone.
You are responsible for:
- The content and lawfulness of everything you host.
- Your own backups, and for testing that you can restore from them.
- The consequences of commands you run through the panel, including the console.
- Keeping your hosting account and domains in good standing.
Acceptable use
The Acceptable Use Policy forms part of these terms. Breaking it is grounds for suspension.
Fees
Equific is a paid subscription. Current pricing, billing period and included limits: [[ PRICING AND PLAN TERMS ]].

Failure to pay may lead to suspension. We will tell you before that happens, and suspension does not stop your servers running — it stops us managing them.
Availability
We do not currently offer a service level agreement. Equific is provided as-is and as-available. We work to keep it up and will tell you when it is not, but there is no uptime commitment, no credit scheme and no guaranteed support response time.
This matters more than usual for this kind of product, so it is worth stating outright: if Equific is unavailable, your servers and sites keep running and keep serving traffic. What you lose is the ability to manage them through us, and monitoring and scheduled backups may not run while we are down.
Your data and backups
Your data stays yours. How we handle it is set out in the Privacy Policy.
Backups Equific takes are written to object storage you own, using credentials you supply. We do not hold a copy, which means we cannot restore your data for you if you lose access to that storage.
Suspension and termination
You may stop at any time by deleting your account. Doing so destroys the key that encrypts your stored credentials, and your servers keep running untouched — export anything you still need first.
We may suspend or close an account that breaches these terms or the Acceptable Use Policy, that has not paid, or where continuing would put other customers or us at risk. Except where the breach is serious or unlawful, we will tell you first and give you a chance to put it right.
Liability

Nothing in these terms limits liability that cannot lawfully be limited.
Changes
We may change these terms. For anything that materially affects you we will give at least [[ NOTICE PERIOD ]] notice by email. Continuing to use Equific after that means you accept the change.
Governing law
These terms are governed by the laws of [[ JURISDICTION ]], and disputes go to the courts of [[ COURTS ]].
